ARTICLE 1 – DEFINITIONS

In these Terms and Conditions, the following definitions apply:

Cooling-off period: the period during which the consumer can exercise the right of withdrawal;

Consumer: the natural person who is not acting for purposes related to their trade, business, or profession and enters into a distance agreement with the entrepreneur;

Duration transaction: a distance agreement relating to a series of products and/or services, where the delivery and/or purchase obligation is spread over time;

Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information;

Right of withdrawal: the possibility for the consumer to withdraw from the distance agreement within the cooling-off period;

Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance;

Distance agreement: an agreement concluded within a system organized by the entrepreneur for distance selling of products and/or services, whereby exclusive use is made of one or more means of distance communication up to and including the conclusion of the agreement;

Means of distance communication: means that can be used to conclude an agreement without the consumer and entrepreneur being physically present in the same place at the same time;

Terms and Conditions: these Terms and Conditions of the entrepreneur.

ARTICLE 3 – APPLICABILITY

These Terms and Conditions apply to every offer made by the entrepreneur and to every distance agreement and order concluded between the entrepreneur and the consumer.

Before the distance agreement is concluded, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated that the Terms and Conditions can be inspected and will be sent free of charge upon request.

If the agreement is concluded electronically, the Terms and Conditions may be made available electronically in such a way that they can be easily stored on a durable data carrier.

If specific product or service conditions apply in addition, the consumer may always rely on the most favorable provision in case of conflicting terms.

If any provision of these Terms is found to be invalid, the remaining provisions will remain in effect and be replaced with a valid provision that closely reflects the original intent.

Situations not covered will be assessed in the spirit of these Terms.


ARTICLE 4 – THE OFFER

If an offer has a limited validity or conditions, this will be explicitly stated.

The offer is non-binding. The entrepreneur reserves the right to modify it.

The offer contains a complete and accurate description of the products/services. Images are a truthful representation, but errors do not bind the entrepreneur.

All images and specifications are indicative and cannot give rise to compensation or termination.

Colors displayed may differ from actual product colors.

Each offer clearly states:

The price (excluding import duties and taxes, which are the customer’s responsibility)
Shipping costs
How the agreement is concluded
Whether the right of withdrawal applies
Payment, delivery, and execution terms
Validity period of the offer
Archiving of the agreement
Correction options before placing an order
Available languages
Codes of conduct
Minimum duration for long-term agreements


ARTICLE 5 – THE AGREEMENT

The agreement is concluded when the consumer accepts the offer and meets the conditions.

Electronic acceptance is confirmed immediately. Until confirmation, the consumer may cancel.

The entrepreneur ensures secure data transfer and payment systems.

The entrepreneur may assess the consumer’s ability to meet payment obligations and may refuse orders.

Relevant information will be provided with the product or service, including complaint handling, withdrawal rights, and guarantees.

All agreements are subject to product availability.


ARTICLE 6 – RIGHT OF WITHDRAWAL

The consumer may withdraw within 30 days without giving a reason.

The consumer must handle the product and packaging carefully and only use it to assess suitability.

Returns must include all accessories and be in original condition.

The consumer must notify the entrepreneur within 30 days and return the product within 30 days after notification.

Proof of return shipment is required.


ARTICLE 7 – COSTS OF WITHDRAWAL

Return shipping costs are borne by the consumer.

Refunds will be issued within 14 days, provided the product has been received or proof of return is provided.


ARTICLE 8 – EXCLUSION OF WITHDRAWAL

The right of withdrawal may be excluded for:

Custom-made or personalized products
Perishable goods
Products unsuitable for return
Sealed products opened by the consumer
Hygiene products
Audio/video/software with broken seals

Also excluded for certain services such as leisure activities, accommodation, or services started with consent.


ARTICLE 9 – PRICE

Prices remain unchanged during validity unless affected by VAT changes.

Price reductions do not entitle compensation.

Prices may vary due to financial market fluctuations.

Import duties and handling costs are the customer’s responsibility.

No liability is accepted for pricing errors.


ARTICLE 10 – COMPLIANCE AND WARRANTY

Products comply with the agreement and legal requirements.

Warranty does not affect legal rights.

Defects must be reported within 30 days.

Warranty does not apply in cases of misuse, modification, or improper handling.


ARTICLE 11 – DELIVERY AND EXECUTION

Orders are processed with care and delivered within 14 days unless agreed otherwise.

Delays will be communicated. Consumers may cancel if delays occur.

Refunds are processed within 14 days after cancellation.

If unavailable, a replacement may be offered.

Risk transfers upon delivery.


ARTICLE 12 – DURATION TRANSACTIONS

Consumers may terminate ongoing agreements with a notice period of up to one month.

Fixed-term agreements cannot be automatically renewed unless stated.

Trial subscriptions end automatically.


ARTICLE 13 – PAYMENT

Payments must be made within 7 working days unless agreed otherwise.

Consumers must report errors in payment details.

In case of non-payment, reasonable costs may be charged.


ARTICLE 14 – COMPLAINTS PROCEDURE

Complaints must be submitted within 7 days.

Responses are provided within 14 days.

If unresolved, disputes may arise.


ARTICLE 15 – DISPUTES

All agreements are governed exclusively by the laws of the United States, regardless of the consumer’s residence.
